Learned advocate appearing for the petitioners submits that similarly placed accused persons have been granted anticipatory bail on 17.04.2026 and 16.06.2026. Learned advocate for the State opposes the prayer for anticipatory bail. Having considered that the case is of the year 2023 and the fact that similarly placed accused persons have been granted relief although the facts are not encouraging but having regard to the overall circumstances, I am inclined to extend the same benefit to the present petitioners. As such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners, namely, Ikbal Sk @ Ikbal Mia and Puchi Sk @ Jintu Sk shall be 2 released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since charge-sheet has already been submitted before this Court, this order of anticipatory bail will remain in force for a period of six weeks from date. Thus, CRM(A)1746 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
