In the said order “West Bengal Panchayat Rural Development Agency” be read as “West Bengal State Rural Development Agency”. The department is directed to incorporate necessary correction. This order be treated as part of the order dated July 08, 2026. The petitioners allege that the Panchayat Authority has constructed a road by encroaching upon a portion of their land in Plot No. 628/1208, Khatian Nos. 2137 and 4916. It appears from the report submitted by the State that upon verification of the office records it is found that the concrete road in question has been constructed over plot no. 628/1208. In view of the State admitting the fact of encroachment of a portion of the petitioners’ land by construction of a concrete road through the same, the Executive Engineer, West Bengal State Rural Development Agency, being the respondent no. 12 herein, is directed to demolish the said portion of the road and restore the land of the petitioners to its original nature and character within six weeks from the date of communication of this order. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
