Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 137.400 kgs. of Ganja and petitioner is in custody for 1 year 6 months. Petitioner is a driver of the vehicle and owner of the vehicle was granted bail. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. Having considered the quantum of recovery in the present case, I am of the view that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. Learned Trial Court would expedite the process of trial as charges have already been framed. 2 The application for bail, being CRM (NDPS) 1270 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
