This is a Writ Petition filed under Article 226 of the Constitution of India seeking following prayers:- “a) Issue an appropriate writ, order or direction, including a writ in the nature of Certiorari, summoning the records of decision taken by respondents in declaring the account of the petitioners are fraud and to quash the same; and b) Issue an appropriate writ, order or direction in the nature of Mandamus directing the Respondent No. 3 to forthwith supply the complete Forensic Audit Report for all the group accounts; and c) Issue an appropriate writ, order or direction in the nature of mandamus directing the Respondent No. 3 to consider the pending OTS Application of the proprietorship concern of the Petitioner No. 1.” This is a digitally signed order. At this stage, the learned Counsel for the Petitioners, on instructions submits that the Petitioners would be confining the prayer to prayer (c) only. 5. Issue Notice. 6. The learned Counsel for Respondents accept Notice. The learned Counsel for Respondent No. 3 submits that in order to consider the OTS Application dated 25.02.2025 made by Petitioner No. 1, Respondent No. 3 would be required to inspect the property at House No. 62, Awadhpuri Colony, Loha Mandi, Agra (“Property”). 7. The learned Counsel for the Petitioners submits that the Petitioners have no objection for allowing Respondent No. 3 to carry out the inspection of the Property, provided Respondent No. 3 is ready and willing to consider the OTS Application made by Petitioner No. 1. 8. Accordingly, by consent of the Parties, Respondent No. 3 is permitted to inspect the property on 07.05.2026. 9. Once the inspection is carried out, Respondent No. 3 shall decide the OTS Application dated 25.02.2025 within a period of 60 days from completion of the inspection. 10. While considering the OTS Application, Respondent No. 3 shall take into consideration all the submissions made on behalf of Petitioner No. 1 and decide the same in accordance with law without being influenced by the fact that the accounts of the Petitioners bearing numbers 725530110000053, 725570710000005 and 725560510000168 were classified as fraudulent. 11.
