ORAL ORDER
1. Accused No.2 in Crime No.105/2026 registered by Harohalli Police Station, Bengaluru South, for the offence punishable under Section 309(4) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.105/2026 was registered by Harohalli Police Station, Bengaluru South, for the aforesaid offence against unknown persons based on the first information dated 04.05.2026 received from Smt. Lakshmamma, who is the alleged victim in the present case. During the course of investigation, petitioner was arrested on 05.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5089/2026 was rejected on 03.06.2026. Therefore, he is before this Court.

Learned counsel for the petitioner submits that investigation of the case is completed and charge sheet has

been filed. Petitioner has no other criminal antecedents. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition submits that accused No.1 had stolen the motorbike in which accused Nos.1 and 2 had arrived at the spot of crime on the alleged date of incident. He submits that in the event, petitioner is enlarged on bail, he may indulge in committing similar offences. Accordingly, he prays to dismiss the petition. 6. Perusal of the first information would go to show that alleged incident had taken place at about 16.45 hours on
04.05.2026. The allegation in the first information is that two persons, who came in a motorbike had snatched the gold chain weighing about 38 grams from the neck of Smt. Lakshmamma and had escaped. During the course of investigation, accused Nos.1 and 2 were arrested and the gold chain was recovered. 7. As per the charge sheet allegations, on the alleged date of incident, petitioner was driving the motorbike, which was earlier stolen by accused No.1 and it was accused No.1, who had pulled the gold chain from the neck of the victim. The

maximum punishment for the alleged offence is imprisonment for a period of ten years. It is not in dispute that petitioner has no other criminal antecedents. Investigation of the case is now completed and charge sheet has been filed. Under the circumstances, the following order:-
8. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.105/2026 registered by Harohalli Police Station, Bengaluru South, for the offence punishable under Section 309(4) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
