JUSTICE PRAVEEN KUMAR ORAL ORDER 2 19-08-2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Dumariyaghat P.S. Case No. 165 of 2026 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 3. As per the prosecution case, on 22.05.2026, the informant received secret information regarding the involvement of the petitioner and other co-accused persons in the manufacturing of illicit liquor. Upon receiving the said information, the informant, along with his police personnel, conducted a raid at the alleged place of occurrence. On seeing the police team, the petitioner and other co-accused persons Patna High Court CR. MISC. No.57931 of 2026(2) dt.19-08-2026 2/3 allegedly fled away from the spot. The local Chowkidar identified the petitioner as one of the persons who had fled from the spot. Thereafter, a total quantity of 200 litres of illicit country-made liquor was recovered beside a canal. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. It has further been submitted that the name of the petitioner has been dragged into this case at the instance of the local Chowkidar, with whom the petitioner is on inimical terms. It has also been submitted that the procedure prescribed under Section 103 of the B.N.S.S. has not been followed. It has further been submitted that the recovery was made from an open place which is accessible to everyone. Lastly, it has been submitted that the petitioner has two criminal antecedents and is in custody since 24.05.2026. 5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner. 6. Heard the parties and perused the record. 7. Considering the aforesaid facts and circumstances of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Patna High Court CR. MISC. No.57931 of 2026(2) dt.19-08-2026 3/3 learned Court concerned, East Champaran, in connection with Dumariyaghat P.S. Case No. 165 of 2026. 8. The application stands allowed.
