Kausik (Allowed) CRM (M) 1338 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kultali Police Station Case No. 122 of 2023 dated 22.02.2023 under Section 302/377/34 of the Indian Penal Code read with Section 6/17 of the POCSO Act. And In the matter of : Mafuja Piyada ……Petitioner. Mr. Sandip Dinda ……for the Petitioner. Mr. Krishnendu Bhattacharya Mr. Anamitra Banerjee ……for the State. Petitioner is similarly situated as the other accused person who has been granted bail by the Hon’ble Supreme Court in SLP (Crl.) No. 6178 of 2026. Learned advocate for the State has raised objection and submitted a report of service being effected upon the defacto complainant. Having considered that similarly placed accused person has been granted bail by the Hon’ble Supreme Court, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Mafuja Piyada shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) 2 with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Baruipur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas South without the prior permission of the learned Trial Court. Thus, CRM (M) 1338 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
