The petitioner apprehends his arrest in connection with Ratwara P.S. Case No. 28 of 2026, registered for the offences punishable under Section 111 of the BNS and Sections 25(1-A), 25(1-B)a, 26 & 35 of the Arms Act. 3. Acting on a tip off regarding running an illegal arms factory in the house of the petitioner, the police conducted raid and recovered a manufacturing unit along with various other incriminating materials, which are being used for the purpose of assembling illegal arms, apart from cartridges. In course of raid, the police apprehended two persons, who have disclosed the name of the petitioner as the associate in running the illegal arms factory. Patna High Court CR. MISC. Learned Advocate for the petitioner submitted that the apprehended person are none-else but the brother of the petitioner and only on account of the animosity and the pressure of the police, they have disclosed the name of the petitioner as an associate in the crime. However, there is nothing on record, which suggest the active complicity of the petitioner. The house from were the recovery has been made is a joint family house and, as such, the petitioner cannot be held responsible for the same. The petitioner is carrying fair antecedent and undertakes that he will fully cooperate in the proceeding of the court. 5. On the other hand, learned Advocate for the State vehemently opposed the bail application. 6. Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the fact that a huge manufacturing unit, besides various half manufactured pistols and cartridges were recovered from the house of the petitioner. This Court is not acceded to the prayer for anticipatory bail of the petitioner. 7.
