Learned counsel for the petitioner submits that the private respondents are raising unauthorized construction without obtaining sanction from the concerned Panchayat. The Pradhan, Patikabari Gram Panchayat issued a stop work notice upon the private respondents and requested them to appear before the authority will all relevant documents. The Pradhan has held that no sanction has been obtained by the private respondents from the Panchayat for raising the alleged construction. The Pradhan forwarded his opinion to the Sub-Divisional Officer, Berhampore Sadar, being the 5th respondent herein, for taking necessary steps in terms of Section 23(5) of the West Bengal Panchayat Act, 1973. No step has been taken by the Sub-Divisional Officer, Berhampore Sadar till date. In view of the fact that the construction raised by the private respondents has been declared to be illegal/unauthorized by the Pradhan, Patikabari Gram Panchayat, the Sub-Divisional Officer, Berhampore Sadar, being the 5th respondent herein, is directed to deal with the correspondence made by the Pradhan, Patikabari Gram Panchayat in this regard in terms of Section 23(5) of the Act and pass a reasoned order within four weeks from the date of communication of this order. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
