Instant petition has been filed under Articles 226/227 and 300-A of the Constitution of India for directing the respondents to treat the petitioner’s validly exercised joint option dated 11.08.2023 (Annexure P-1) for higher pension under EPS, 1995 as subsisting and operative to re-ssue/revive the demand letter dated 03.10.2024 or re- calculate the dues to accept the requisite contribution along with interest and to grant consequential benefit of higher pension on actual wages under the Employees’ Pension Scheme, 1995 by issuing fresh and revised Pension Payment Order in favour of the petitioner. 2. Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the judgment of this Court dated 09.10.2025 (Annexure P-8) passed in CWP-29633 of 2025 – Hazara RAVINDER SINGH 2026.07.14 17:39 I attest to the accuracy and authenticity of this order/judgment 2 CWP-20268 of 2026 Masih v. The Employees Provident Fund Organization and others as well as the judgment dated 23.01.2026 (Annexure P-9) rendered in CWP-1696 of 2026 – Hari Om and others v. Union of India and others; judgment dated 21.04.2026 (Annexure P-10) rendered in CWP- 7181 of 2026 – Lakhwinder Masih and others v. The Employees Provident Fund Organization and others and judgment dated 25.05.2026 (Annexure P-11) rendered in CWP-16475 of 2026 – Harmeet Kaur v. Union of India and others. Learned counsel for the petitioner submits that for redressal of his grievances, petitioner has moved representations dated 02.05.2025, 08.05.2025 and 11.07.2025 (Annexure P-4 to P-6) to the respondents, which are still pending consideration. Learned counsel for the petitioner submits that the petitioner may be given liberty to supplement the said representations by filing a fresh representation and the same may be considered and disposed of by respondent No.3 in a time-bound manner. 3. Notice of motion to respondents No.2 to 5 only at this stage. 4. Mr. Rajesh Hooda, Advocate, accepts notice on behalf of the respondents No.2 to 4 and on the asking of the Court, Mr. Abhilaksh Gaind, Advocate, who is on the panel of Punjab Small Industries and Export Corporation, accepts notice on behalf of respondent No.5 and they have no objection to the innocuous prayer made by learned counsel for the petitioner. I have heard learned counsel for the parties and have gone through the record of the case. 6. Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, respondent No.3 is directed to consider and decide the claim made in the representations (Annexure P-4 to P-6) and supplementary representation, if any moved by the petitioner within a period of two weeks, by passing a speaking order in the light of the aforesaid judgments, after granting an opportunity of hearing to the petitioner, within a period of three months from the date of receipt of said representation.
