1. The present MCC has been filed seeking restoration of WPS No. 3185 of 2023, which was dismissed for want of prosecution vide order dated 19.06.2026, along with the connected matter.
2. Learned counsel for the petitioner submits that on the date of hearing, none could appear on behalf of the petitioner as the matter was being handled by the petitioner's previous counsel. It is submitted that the petitioner was unaware of the non-appearance and the consequent dismissal of the writ petition and came to know about the same only subsequently, whereafter he immediately engaged the present counsel and filed the instant application. It is further submitted that the absence was neither deliberate nor intentional and that the petitioner has always been interested in prosecuting the writ petition. Hence, restoration of WPS No. 3185 of 2023 is prayed for.
3. On due consideration of the submissions made and for the reasons assigned in the application, duly supported by an
3 affidavit, this Court is satisfied that sufficient cause has been shown for restoration of WPS No. 3185 of 2023.
4. Accordingly, the MCC is allowed. The order dated 19.06.2026 dismissing WPS No. 3185 of 2023, along with the connected matter, for want of prosecution is recalled. The Registry is
directed to restore WPS No. 3185 of 2023 to its original number. Sd/-
