20.07.2026 Item No.26 (DL) Court No.7 AJ. IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION W.P.A. 14827 of 2026 < Sukanta Nandy -Vs- The State of West Bengal & Ors. Mr. Himadri Barua, Mr. Shakti Chakraborty, Ms. Rituparna Das. …for the petitioner. Mr. Srijan Nayek, Mrs.Rituparna Maitra. …for the WBSEDCL. 1. This writ petition alleges arbitrary action on the part of the respondent WBSEB Authorities in failing to comply with the order dated September 01, 2006 passed by the Ombudsman, West Bengal Electricity Regulatory Commission. 2. The petitioner had approached the Ombudsman with a grievance that the petitioner’s electricity supply had been illegally disconnected. The petitioner had also sought for compensation for illegal disconnection. The petitioner’s grievance was answered by the Ombudsman by an order dated September 01, 2006 in the following manner :- 1. WBSEB shall reconnect the STW line of Sri Sukanta Nandy within 15 days from the date of this order. 2. WBSEB shall pay compensation to the petitioner from the date of disconnection 2 i.e. from 5.12.2005 till the date of reconnection, in terms of Clause 6.05.2 of the WBERC Regulation 13 dt. 05.02.2004 (Electricity Supply Code).” 3. It is submitted by the petitioner that while the first part of the order passed by the Ombudsman was complied with and electricity line was restored, second part was never carried out. 4. Mr. Nayak, learned Advocate appearing for the respondent WBSEDCL Authorities submits that the electricity line was reconnected on November 25, 2006. However, it is not in dispute that the petitioner has not been paid any compensation in terms of the order passed by the Ombudsman. 5. It is, therefore, clear that, the petitioner’s grievance that the Ombudsman’s order dated September 01, 2006 has not been fully complied with is justified. It is nobody’s case that the said order has been appealed against or has been set aside by in superior forum. 6. In such view of the matter, the order passed by the Ombudsman ought to have been complied with to the hilt by the respondent electricity authorities. 7. It is submitted by Mr. Nayak that the WBSEB today stands renamed as WBSEDCL. 3 8. Accordingly, the respondent WBSEDCL authorities are directed to comply with the order dated September 01, 2006 whereby the Ombudsman had directed the said authorities to pay compensation to the petitioner from the date of disconnection i.e. from 5.12.2005 till the date of reconnection, in terms of Clause 6.05.2 of the WBERC Regulation 13 dated 5.2.04 (Electricity Supply Code) within a period of four weeks from the date of communication of this order. 9. WPA 14827 of 2026 stands disposed of with the above observations. There shall be no order as to costs. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
