THIS MISCELLANEOUS FIRST APPEAL COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER The appellant and respondent No.2 are present in person, who have been identified by their respective advocates. On behalf of the appellant/National Highways Authority of India1, Sri Saurabh Choudhary, Manager (Tech) Project Implementation Unit (PIU) Bangalore, is present along with an authorization letter dated 06.07.2026. The authorization letter is signed by Sri K.B.Jayakumara, Project Director, PIU-Bangalore. The authorisation letter authorises Sri Saurabh Choudhary to be present before this High Court at Bangalore and on behalf of NHAI, PIU, 1 NHAI 3 Bangalore to attend for mediation/Lok Adalat in respect of M.F.A.No.3579/2026 filed by NHAI against Sri Channegowda respondent No.2 which is pending before the High Court. He has also been authorized to sign the contract on the joint memo and the order sheet on behalf of NHAI. 2. Respondent No.2/Channegowda is also present and appears to have injury in his right hand. Therefore, leave was sought by him to affix his left thumb impression to the settlement instead of signing the same. He is permitted to do so. He has filed a copy of his Aadhaar card on which his thumb impression is affixed and identified by his advocate. 3. The identity card of NHAI issued in favour of Sri Saurabh Choudhary, Manager, which is valid upto February 2028 is also produced. The authorisation letter as well as copies of the identity proofs of the signatories have been submitted along with a joint memo filed today. 4. The aforesaid parties have agreed to settle the claim for a principal amount of Rs.5,85,12,748/- awarded by respondent No.1 4 in the proceedings concerned, by waiving off the entire extent of interest awarded therein without prejudice to the grounds urged in the aforesaid appeal. 5. The appellant has agreed to pay and respondent No.2 has voluntarily of his own free will agreed to accept the aforesaid amount of Rs.5,85,12,748/- in full and final settlement of the claim. The name of the bank and the account number of respondent No.2 have been stated in the joint memo. However, the appellant/NHAI has sought to introduce a mode of payment of the amount settled between the parties, subject to verification of the bank account mentioned in the joint memo by the Special Land Acquisition Officer and Competent Authority, NHAI (SLAO & CA) (Respondent No.3). Accordingly, they have sought refund of the deposited amount to the appellant’s Bank Account, pursuant to which the aforesaid sum shall be credited to the bank account of respondent No.2 as per the settlement. 6. Respondent No.2 and his Counsel consent to the aforesaid mode of payment. The joint memo is accordingly accepted. An award shall be made by the office within one month 5 from today. Office shall within a fortnight thereafter, refund the deposited amount to the appellant's bank account with accrued interest, if any, to the bank account of NHAI which is stated to be as follows: Name : SLAO-Project Director NHAI (NH-7/KNTII) Regular Name of the Bank : IndusInd Branch : Basavanagudi, Bangalore Account Number : 201001336741 IFSC Code : INDB0000039 7. The Special Land Acquisition Officer/the Competent Authority/respondent No.3 is directed to undertake the verification exercise within ten days of crediting of the amount to the account of NHAI. The appellant shall ensure that Special Land Acquisition Officer/respondent No.3 is promptly communicated the date of credit of the aforesaid money to the account of NHAI. After verification by the Special Land Acquisition Officer/respondent No.3, or after 10 days from the date of crediting to the account of NHAI by the High Court, whichever date is earlier, the settled amount shall be credited to the account of respondent No.2. 6 The appeal is, accordingly, disposed of.
