The writ petition alleges inaction on the part of the respondent Police Authorities in implementing the order dated January 30, 2019 passed by the learned Chief Metropolitan Magistrate, Calcutta on an application under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 filed by the petitioner bank. 2. Mr. Pramanick, learned advocate appearing for the petitioner takes this Court through the order dated January 30, 2019 passed by the learned Chief Metropolitan Magistrate, Calcutta and submits that by the said order, the Assistant Registrar Bankshall Court had been directed to take physical possession of the property mentioned in the schedule of the said application under Section 14 of the 2002 Act and to hand over the same to the authorized officer of the petitioner bank who is the secured creditor. 2 3. It is submitted that despite the said order, no action has been taken by the respondent State Authorities. 4. It is submitted that Mr. Pramanik, that the order dated January 30, 2019 has neither been challenged nor stayed by any order passed by any forum. 5. Having heard the learned advocates appearing for the respective parties and having considered the material on record, this writ petition is disposed of by directing the respondent nos. 3 and 5 to take appropriate steps for implementation of the order dated January 30, 2019 passed by the learned Chief Metropolitan Magistrate, Calcutta, on the petitioners’ application under Section 14 of the 2002 Act. 6. The respondent nos. 3 and 5 shall take expeditious steps to ensure implementation of the aforesaid order within a period of four weeks from the date of communication thereof. 7. The petitioners shall communicate this order to the respondent nos. 3 and 5 immediately. 8. With the above observations, WPA 15803 of 2026 stands disposed of. There shall be no order as to costs. 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.) 3
