W.P.(CRL) 1271/2026 By way of the present petition filed under Article 227 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks a direction to the learned Chief Judicial Magistrate, New Delhi District, Patiala House Courts, New Delhi to decide his application filed under section 156(3) of the Code of Criminal Procedure 1973 (‘Cr.P.C.’) bearing Ct. Cases No. 652/2022, in an expeditious and time-bound manner. 2. Mr. Alok Bachawat, learned counsel appearing for the petitioner submits, that the petitioner had filed the application under section 156(3) of the Cr.P.C. on 09.04.2022, which came to be listed before the learned CJM on first on 19.04.2022, when an Action Taken Report (‘ATR’) was called from the respondent (State). Mr. Bachawat submits, that thereafter the matter has been heard at length on multiple occasions, but no decision has been taken thereon, though multiple ATRs have been called by the learned CJM, without culminating in any order. 4. Mr. Bachawat has drawn attention to the order-sheets of the matter spanning about 04 years, copies of which have been appended to the petition. 5. Mr. Bachawat has also drawn attention to an order dated 14.03.2026, to point-out that in view of the unacceptable position obtaining in the matter, by the said order the learned CJM had directed as follows: “It is stated by the IO that he has since been transferred and the present holding IO is Inspector Vishal Chaudhary. It is further stated that the inquiry was initially conducted by Inspector Vijay Kumar and he had filed the inquiry report initially. Accordingly, both Inspector Vishal Chaudhary and Inspector Vijay Kumar be summoned through DCP concerned for NDOH. “Ld. Counsel for Union of India also states that authorised representative shall remain present in Court on NDOH to assist with regard to role of Multi State Cooperative Society, 2002 and office of Central Registrar.” (emphasis supplied) 6. Counsel submits, that the petitioner is seeking registration of an FIR against certain persons in relation to the affairs of a Multi-State Cooperative Society. 7. Issue notice. 8.
