The petitioner who is the Upa Pradhan of Sripur I Gram Panchayat has assailed the no confidence motion submitted by the members of the Panchayat/private respondents for her removal before the Prescribed Authority on 29th June, 2026 on the ground that party affiliation of seven members has not been stated in the second page of the motion. Learned counsel for the petitioner produces the original motion received by the Panchayat at the Panchayat office as well as the residence of the petitioner in support of his contention. In view of the fact that the second page of the motion does not bear the party affiliation of seven members, the motion is in violation of Section 12(2) of The West Bengal Panchayat Act, 1973 and cannot be acted upon. The motion is quashed/set aside. However, the members/private respondents are at liberty to submit a fresh motion before the Prescribed 2 Authority in terms of Section 12 of the Act of 1973. On receipt of such motion, the Prescribed Authority is directed to deal with the same in terms of the said provision of law, particularly the time frame stipulated therein. If the meeting is convened by the Prescribed Authority pursuant to such motion, the Inspector in charge, Pukhuria Police Station, being the 10th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully without any disturbance from any corner whatsoever. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
