APP Mr. Koustav Lal Mukherjee … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year and he was not initially arrested but, subsequently, arrested on the basis of statement of a co-accused. Learned advocate also submits that there has been obviously some recoveries from the present petitioner, particularly, the arms. It has been informed by the learned advocate for the State that out of the seven witnesses cited, five witnesses witnesses have already been examined. Learned advocate for the State further submits that two more witnesses would be completed within a period of three months. 2 Having considered the advanced stage of the case, at this stage, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. The petitioner would renew his prayer for bail after the evidence of the two witnesses claimed to have been left out by the prosecution is complete within the scheduled period.
