Kausik (Rejected) CRM (NDPS) 1244 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Baishnabnagar Police Station Case No. 542 dated August 18, 2023 under Sections 21(c)/25/29 of the NDPS Act, 1985. And In the matter of : Majibar Sekh @ Majibar Sk @ Mojibur Sekh @ Mojibar Sekh ……Petitioner. Mr. Ayan Bhattacharjee, Sr. Adv. Mr. Shounak Mondal ……for the Petitioner. Mr. Kallol Mondal, Sr. Adv., PP Mr. Krishnendu Bhattacharya, APP Mr. Mukesh Gupta ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years and 11 months and there has hardly been any progress of the case. It has also been contended that there was no recovery from the present petitioner and there being no possibility of the trial being concluded in near future, the petitioner may be released on bail on any condition. Learned Public Prosecutor appearing for the State on the earlier date has submitted a report. Today also he has submitted a report. Total quantum of recovery in this case is 9.989 Kgs. of Heroin. Evidence of the case has been 2 progressing. Six witnesses are complete, one witness, being P.W. 7 has been deferred on the ground of medical treatment of the said witness and date has been fixed on 21.08.2026. It has also been submitted that 4 more witnesses are to be examined. The basis on which the present petitioner has been implicated is on the basis of CDRs. Be that as it may, in view of the huge quantity of contraband recovered in the present case and 4 months time has been prayed by the State, I am inclined to grant the said 4 months to the prosecution. Prosecution would complete rest of the witnesses within a period of 4 months. No unnecessary adjournment be granted to any of the parties and the trial of the case would continue in spite of any resolution of the local bar. With the aforesaid observations CRM (NDPS) 1244 of 2026 is dismissed at this stage. The Deputy Superintendent of Police, In-charge of STF, West Bengal is present personally. His appearance before this Court is dispensed with. Registrar General, High Court, Calcutta will communicate this order to the learned Trial Court. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
