This is the Second bail application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 59/2025 registered at Police Station – Purani Basti, District- Raipur (C.G.), for the offence punishable under Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution, in brief, is that on 26/02/2025, based on information received from an informant, the police at Police Station Purani Basti, Raipur, seized from the accused's possession, near Ashok Vatika, PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.02.12 15:21:42 +0530 2 Bhatagaon, Raipur, District Raipur (CG), a restricted psychotropic substance, a white powder-like substance (drugs) weighing 7.15 grams, which was found in a zip-lock polythene pouch in the accused's full pants pocket. A case under Section 21(B) of the NDPS Act was registered against the applicant/accused at Police Station Purani Basti, Raipur, vide Crime No. 59/2025, and after investigation, a charge sheet has been filed. 3. The first bail application of the applicant was rejected by this Court on merit vide order dated 26.06.2025 passed in MCRC No. 3399/2025. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant has been in jail since 26.02.2025, and so far as the status of the trial is concerned, out of 10 witnesses, 07 have been recorded. He further submits that the applicant has no previous criminal antecedents and that the conclusion of the trial may take some time. Therefore, he prays that the present applicant be granted regular bail. 5. Learned counsel for the State opposes the bail application and submit that the charge-sheet has been filed in the present case before the competent Court. He further submits that first bail application of the applicant was rejected by this Court on merit vide order dated 26.02.2025 passed in MCRC No. 3399/2025, as such, the applicant is not entitled to be released on bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Taking into consideration the fact that this is the second bail application filed by the applicant, and it transpires from the record that the first bail application was rejected by this Court vide order dated 26.02.2025 passed in MCRC No. 3399/2025 on merits, and further considering the 3 status of the trial, wherein out of 10 witnesses, 7 have already been examined and the trial is on the verge of completion, this Court is of the opinion that this is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the second bail application of the applicant - Devi Das Vaishnav filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, involved in Crime No. 59/2025 registered at Police Station – Purani Basti, District- Raipur (C.G.), for the offence punishable under Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 9. However, this Court hope and trust that the trial Court shall make an earnest endeavour to conclude the trial within a period of two months from the date of receipt of a certified copy of this order, if there is no legal impediment. 10.
