And In the matter of : Jayanta Mandal. ……Petitioner. Mr. Arup Kumar Bhowmick .....for the Petitioner. Mr. Gauranga Kumar Das, Ld. APP Mr. Amartya Mohan Bhattacharyya ……for the State. Learned advocate appearing for the petitioner submits that petitioner surrendered on 12.05.2026 after his anticipatory bail was rejected and since then he is in custody. The other accused persons have been granted bail, as such petitioner be released on bail. Learned advocate appearing for the State submits that the total quantum of seizure in the present case is of commercial quantity of contraband. Emphasis has been laid on the factum that petitioner surrendered after three witnesses were examined and this is why there has been delay in the present case. Further, at the time of raid the investigating agency were fired at by some of the accused persons. Having regard to the conduct of the present petitioner who has been evading the process of law for a considerable period of time 2 and has contributed to the delay in the present case, at this stage, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1314 of 2026 is dismissed. Memo of evidence submitted b y the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
