Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 4 months and charge-sheet has already been submitted before the jurisdictional court, but till date witness action has not commenced. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that recovery was pursuant to the leading statement of the present petitioner and there were two seizures pursuant to such leading statement - one being 61.200 kgs. of Ganja and another being 24 kgs. of Ganja. Having considered the materials appearing, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. 2 The application for bail, being CRM (NDPS) 1254 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
