Accused No.3 in SC No.60/2026 pending before the Court of Principal District and Sessions Judge, Chikkamagaluru, arising out of Crime No.2/2026 registered by Basavanahalli Police Station, Chikkamagaluru, for the offences punishable under Sections 311, 118(1), 351(2) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.2/2026 was registered by Basavanahalli Police Station, Chikkamagaluru, for the aforesaid offences against two unknown persons based on the first information dated 21.01.2026 received from Ravi Kumar, who is the injured victim in the present case. During the course of investigation, petitioner was arrested on 25.01.2026 and remanded to judicial custody. In the charge sheet, which is filed subsequently against three persons, petitioner is arraigned as accused No.3. His bail application filed before the Trial Court in SC - 3 - HC-KAR CNR: KAHC010383862026 NC: 2026:KHC:36673 CRL.P No. 8058 of 2026 No.60/2026 was rejected on 29.05.2026. Therefore, he is before this Court. 4. FIR in the present case was registered against two unknown persons alleging that on 17.01.2026, CW1 - Ravi Kumar, was taken by unknown two persons in an auto rikshaw and after assaulting him, they had snatched amount of Rs.8,500/- from him and had escaped. In respect of the alleged incident that had taken place on 17.01.2026, FIR was belatedly filed on 21.01.2016. During the course of investigation, police have arrested three persons and petitioner is arraigned as accused No.3 in the charge sheet. As per the charge sheet allegations on 17.01.2026 when CW1 was consuming alcohol in a wine store, accused Nos.2 and 3, who went there had asked him to provide liquor to them and on their request, he had provided liquor to accused Nos.2 and 3, who thereafter on the guise of dropping him to the nearby bus stand had taken CW1 in the auto rikshaw belonging to accused No.1. Thereafter, they had assaulted him and had snatched a sum of Rs.8,500/- from his pocket and had escaped. - 4 - HC-KAR CNR: KAHC010383862026 NC: 2026:KHC:36673 CRL.P No. 8058 of 2026 5. It is not in dispute that the petitioner herein has no other criminal antecedents. Investigation of the case is completed and charge sheet has been filed. The alleged offences are not punishable with death or life imprisonment. Considering the nature of allegations found against the petitioner and also the delay in approaching the police, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.60/2026 pending before the Court of Principal District and Sessions Judge, Chikkamagaluru, arising out of Crime No.2/2026 registered by Basavanahalli Police Station, Chikkamagaluru, for the offences punishable under Sections 311, 118(1), 351(2) read with Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR CNR: KAHC010383862026 NC: 2026:KHC:36673 CRL.P No. 8058 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
