2. The petitioners are apprehending their arrest in connection with Latehar P.S. Case No.58 of 2025 for the alleged offences

registered under Sections 190, 191(1), 191(2), 115(1), 76, 333, 196(1), 352 and 351(2) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Latehar.

Learned counsel appearing for the petitioners submits that the present case is counterblast of the case being Latehar P.S. Case No.57 of 2025 which has been lodged by one Md. Shamim Alam, wherein it has been alleged that the relative of the informant had tried to kill the son of the informant who is undergoing treatment in the hospital. He further submits that even no injury was found on the person of the informant which further falsify the allegation made in the FIR. He then submits that there are general and omnibus allegation against mob of 250 persons and no specific overt act has been alleged against the petitioners. He next submits that in identical situation one co-accused has been granted anticipatory bail in ABA No.4916 of 2025.

Learned counsel appearing for the State opposed the prayer and submits that allegations are there against 250 persons of assault.

Looking into the contents of the FIR it transpires that there are general and omnibus allegation against mob of 250 persons including the petitioners and no injury was found on the body of the informant and in identical situation one co-accused person has been granted anticipatory bail in the aforesaid ABA and it has been pointed out that the present case is counterblast case of Latehar

P.S. Case No.57 of 2025 and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
