1. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 13.03.2026 in connection with Crime No. 09/2026 registered at Police Station - Tarbahar Bilaspur District - Bilaspur (C.G.) for the offence under Sections 303(2) of the BNS.

The case of the prosecution is that on 03.01.2026, between 1:00 p.m. and 11:30 p.m., the complainant, Bhupendra Kumar Deshlahare, had parked his Activa Scooty bearing Registration No. CG 10 BQ 7051 in the parking area of Zudio Cloth Shop, within the jurisdiction of Police VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.07.25 13:03:50 +0530
2 Station Tarbahar, District Bilaspur. It is alleged that during the said period, the applicant dishonestly removed and stole the said scooty, valued at approximately Rs. 35,000/-, without the consent of the complainant and with the intention of committing theft. On the basis of these allegations, the applicant was implicated in the present case and the crime was registered against him.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case and has not committed any of the alleged offences. Learned counsel further submits that the investigation has been completed, the charge-sheet has already been filed, and no further custodial interrogation of the applicant is required. It is submitted that the applicant has one criminal antecedent in Crime No. 233/2025, registered at Police Station Moudhapara, District Raipur, in which he has already been granted bail by this Hon'ble Court in MCRC No. 5382/2026 vide order dated
23.06.2026. It is further submitted that the applicant is a Bachelor of Engineering student and that his continued incarceration would seriously prejudice his education and future career. The applicant is a permanent resident of the address mentioned in the cause title, there is no likelihood of his absconding or tampering with the prosecution evidence, and he undertakes to abide by all the terms and conditions that may be imposed by this Court. Therefore, it is prayed that the applicant be enlarged on regular bail.
4. On the other hand, learned State counsel vehemently opposed the bail application and submitted that although the charge-sheet has been filed, the applicant has one criminal antecedent. Therefore, considering
3 his criminal antecedent and the nature of the allegations, he is not entitled to the grant of regular bail.

Considering the facts and circumstances of the case, the nature of allegation levelled against the present applicant, and also taking into account that the applicant has one criminal antecedent, that the charge-sheet has been filed before the competent Court, and the applicant has been in jail since 13.03.2026, and final adjudication of the case will take its own time, I am inclined to release the applicant on bail.
6. Consequently, the bail application filed by the applicant Abhishek Pradhan @ Baba for grant of regular bail is hereby allowed. It is
directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs. 50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, on following conditions:- (i) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (ii) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) The applicant shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial unless their personal presence is exempted by the trial Court.
