1. Affidavit-of-service filed in Court today is taken on record.
2. The petitioner alleges to be the spouse of one Subhas Bouri, who was employed with the respondent no. 1 for a very long period of time. The said Subhas Bouri expired on July 21, 1993, whereupon the petitioner had applied for compassionate appointment in his place and stead. The application was rejected and further applications of similar nature made successively by the petitioner have also been rejected.
3. The petitioner presently claims her entitlement to Monthly Monetary Cash Compensation (hereinafter referred to as ‘MMCC’) since 1993. The petitioner’s application of January 8, 2025 has been kept pending by the authorities, seeking certain clarifications as to why the application has been made after such a prolonged period and also sought for disclosure of all previous correspondences by and between the petitioner and the respondent no. 1.
4. These clarifications sought for by the authorities are fairly redundant. The petitioner has only to prove that Subhas Bouri was employed in respondent no. 1 during his lifetime and
2 that he has expired, thereby entitling the petitioner as his spouse to MMCC.
5. The respondent authorities are directed to dispose of the representation dated January 8, 2025, upon the petitioner fulfilling the afore-stated conditions by August 31, 2026. The resultant order be communicated to the petitioner immediately and if found eligible, the disbursement should start from September, 2026.
6. The respondent authorities are also directed to consider the arrears, if the petitioner is found to be eligible and requisite interest thereon, if the petitioner can show that she had applied for disbursal of such MMCC at the relevant time.
7. With the afore-stated directions, WPA 15613 of 2026 is disposed of.
8. There shall be no order as to costs.
9. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
