Affidavit of service filed by the petitioner and report submitted by the State are taken on record. The Panchayat is not represented despite service. The petitioner and the private respondent are admittedly full-blood brothers and co-sharers in respect of the plots in question. The petitioner alleges that the private respondent is raising construction therein without obtaining sanction from the concerned Panchayat. The petitioner submitted a representation in this regard before the concerned authority on 13th June, 2026 and seeks consideration of the same. It is submitted on behalf of the private respondent and also appears from the report that the sanction for construction has been granted in favour of the private respondent by the concerned Panchayat. 2 Therefore it cannot be said that the alleged construction is being raised without a sanctioned building plan. In view of the above, this Court is inclined to hold that nothing further remains to be dealt with in the present application. The same is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
