1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent to revise the pension of the petitioner on the basis of the service rendered by him during the period when the management of the school was was also in the hands of quashi-governmental/private management i.e. from the date of his original appointment and not the date of appointment as done in case of Shri B.P. Bajpai and in the case of Shri K.D. Sagar & Ors. 10.2 It is also prayed that the respondent be further directed to pay the entire arrears of pension along with interest at the rate of 18% after revision of his pension taking into consideration the total period of service rendered by the petitioner during the quashi-governmental / private management as well as government management. 10.3 Any other relief, which may deem fit and proper in the circumstances of the case, in the interest of justice.”
2. Learned counsel for the petitioner submits that the present petitioner who has superannuated from the post of District Education Officer on
30.11.2012. He contended that upon superannuation of the petitioner, the retiral benefits being granted to petitioner and the fixation of pay has wrongly been computed by the respondent authorities wherein, the respondent authorities have not considered the services rendered by the petitioner as Teacher, Government Higher Secondary School, Bhilai Steel Plant prior to 31.10.1994 as the said school was a quasi-governmental school. 3. He submits that the petitioner has already submitted a representation dated 25.09.2012 (Annexure P/8) before the Respondent No. 1, however, he submits that petitioner may be permitted to submit a fresh representation before the concerned respondent authorities raising all the grounds as raised in this writ petition for redressal of his grievance and
3 further, the concerned authority be directed to consider and decide the representation of the petitioner at the earliest within specified time frame. 4. On the other hand, learned counsel for the Respondents would submit that as the petitioner is not pressing this writ petition on merits and is only seeking permission to submit afresh representation and direction to the concerned authorities to consider and take decision on the representation submitted by the petitioner, he is having no objection to the limited prayer. 5.
I have heard learned counsel for the parties and perused the documents placed on record. 6. Be that as it may, petitioner is permitted to submit a fresh representation before the concerned respondent within a period of 06 weeks from the date of receipt of copy of this order and if such a representation is submitted by the petitioner, the concerned authority shall consider and take decision on the representation to be submitted by the petitioner within a further period of 04 weeks from the date of receipt of the said representation by passing a reasoned and speaking order, absolutely in accordance with law. It is made clear that this Court has not expressed any opinion on the merits of the matter. 7. With the aforesaid observation and direction, this writ petition stands
