And In the matter of : Rafikul Islam. ……Petitioner. Mr. Pulakesh Bajpayee .....for the Petitioner. Mr. Sagar Saha Ms. Nayana Mukhopadhyay ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused person who has been granted bail in CRM (NDPS) 862 of 2026. Learned advocate appearing for the State opposes the prayer for bail but is unable to refute the contention that the present petitioner is not similarly situated as the accused person namely, Golam Murtoza @ Golam Mortuja @ Golam Murtaza who has been granted bail. Having considered the aforesaid, I am inclined to extend the same benefit to the present petitioner. As such, present petitioner namely, Rafikul Islam be released on bail on same terms and conditions as was imposed in CRM (NDPS) 862 of 2026. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1324 of 2026 is allowed. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
