20.07.2026 IN THE HIGH COURT AT CALCUTTA Item No.62 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Allowed C.R.M. (NDPS) 1343 of 2026 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with English Bazar Police Station Case No. 105 of 2026 dated 21.01.2026 under Sections 21(c)/29/27A of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Biswajit Singha ... Petitioner. Mr. Amitabha Karmakar, Mr. Arup Kumar Bhowmick ... For the Petitioner. Mr. Sagar Saha, Ms. Nayana Mukhopadhyay ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as the other accused person viz. Samrat Das who has been granted bail on 01.07.2026 in CRM(NDPS) 1228 of 2026. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail, but is unable to refute the contentions of the petitioner that the present petitioner is not similarly placed as the other accused who has been granted bail in CRM(NDPS) 1228 of 2026. Having regard to the fact that the petitioner is similarly situated as the other accused viz. Samrat Das who has been granted bail on 01.07.2026 in CRM(NDPS) 1228 of 2026, I am of the opinion that the present petitioner viz., Biswajit Singha be released on bail by the learned Trial Court on the 2 same terms and conditions as the other accused who has been granted bail in CRM (NDPS) 1228 of 2026. Accordingly, the prayer for bail of the petitioner is allowed. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1343 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
