Affidavit of service filed by the petitioners is taken on record. Opposite parties are not represented. In this application, the petitioner has prayed for expeditious disposal of G.R. case no. 1183 of 2007, presently pending before the Learned Judicial Magistrate, 3rd Court, Sealdah. Being aggrieved by the aforesaid proceeding, learned counsel for the petitioners submits that the FIR was initiated on 25.7.2007 and after completion of investigation, charge-sheet was submitted on 2.5.2008. Thereafter, the charge was framed on 15.1.2009 and the court below started recording evidence on 16.5.2009, but since then the recording of evidence has still not yet been completed. Accordingly, the petitioners have prayed for necessary direction upon the court below for expeditious disposal of the said proceeding. Having heard learned counsel for the petitioners, it appears that the trial of the said proceeding has got stalled for about more than 17 years and as such, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.
2 In view of above, the instant application being CRR 436 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the said proceeding, which is pending for trial for the last 17 years and to make his best effort to conclude the entire proceeding preferably within a period of three months from the next date of hearing. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
