Learned advocate appearing for the petitioner submits that the marriage was solemnized about four years ago and he has been falsely implicated on trivial family disputes. Learned advocate for the State has produced the case and opposed the prayer for bail. I have taken into account the injury report. Having considered the same, I am of the opinion that although a case has been made out but custodial detention of the present petitioner is unwarranted. As such, the prayer for anticipatory bail is allowed. Accordingly, in the event of arrest, the petitioner, namely, Dipak Mondal shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under 2 Section 438(2) corresponding to Section 482(2) of the BNSS. As the charge-sheet has not been submitted in the present case, the petitioner shall once in every ten days meet with the investigating officer of the case till the submission of the charge- sheet. Accordingly, CRM(A)974 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
