This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 328/2026 registered at Police Station-City Kotwali, Balodabazar District Balodabazar-Bhatapara (C.G.), for the offence punishable under Sections 318(4) of BNS, 2023 and Section 66(E) of Information Technology (amendment) Act, 2008. 2. Case of the prosecution, in brief, is that on 23.02.2026, the victim KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 lodged a written complaint before Police Station City Kotwali, Balodabazar alleging that the holder of Mobile No. xxxxxx1205 threatened to make her obscene photographs viral and demanded a sum of Rs.12,000/-, failing which he would upload the said obscene photographs on Facebook. It is further alleged that the holder of Mobile No. xxxxxx5136 also demanded money from the victim, pursuant to which she paid him a sum of Rs.2,000/-, however, thereafter, he further demanded an additional amount of Rs.10,000/-. On the basis of the written complaint lodged by the victim, the police registered the aforesaid offence against the holders of Mobile Nos. xxxxxx1205 and xxxxxx5136. During the course of investigation, the present applicant came to be arrested and after completion of investigation, the charge-sheet has been filed before the competent Court. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that there is no transaction of money in the mobile phone of the present applicant and there is no evidence in the charge-sheet to show that the said mobile number was being used by the present applicant. He submits that the mobile number disclosed by the victim is registered in the name of the applicant's wife, however, no bills pertaining to the said mobile number have been seized by the Police. He further submits that the applicant is in jail since 29.04.2026, the charge-sheet has been filed before the competent Court and the final adjudication of the case is likely to take some time. Hence, the applicant be enlarged on bail. 3 4. On the other hand, learned State counsel opposes the prayer for grant of bail and submits that, looking to the nature of the offence and the manner in which the crime has been committed by the applicant and also considering that the applicant is having one criminal antecedent of a similar nature, he is not entitled to be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the submissions advanced by learned counsel for the parties, nature of the allegations and the material collected during the course of investigation and further considering that the manner in which the alleged offence is said to have been committed, as well as the fact that the applicant is having one criminal antecedent of a similar nature, I am not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Mewalal Urf Ajay, involved in Crime No. 328/2026 registered at Police Station-City Kotwali, Balodabazar District Balodabazar-Bhatapara (C.G.), for the offence punishable under Sections 318(4) of BNS, 2023 and Section 66(E) of Information Technology (amendment) Act, 2008, is rejected. 8.
