2. The petitioner seeks bail in connection with Bath P.S. Case No. 68 of 2025 corresponding to POCSO No. 244 of 2025 registered for the offence punishable under Section 96 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl. He is in custody since
19.07.2025.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as the victim in her statement has not supported the prosecution case.
5. Learned APP appearing for the State has vehemently opposed the prayer for regular bail of the petitioner.

6. From the statement of the victim girl recorded under Section 183 of the B.N.S.S., it appears that the victim was in a relationship with the petitioner and had eloped with him on her own will. Thus, she has not supported the prosecution case.
7. Considering the statement of the victim girl recorded under section 183 of the B.N.S.S., this application is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court of POCSO-Cum-District & Additional Sessions Judge-VI, Bhagalpur/ concerned Court in connection with Bath P.S. Case No.68 of 2025.
9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
