Gupta … for the State-respondent(s) Learned advocate appearing for the petitioners submits that the petitioners have been falsely implicated on trivial issues. Learned advocate for the State opposes the prayer for anticipatory bail and by producing the case diary has drawn the attention of the court to the treatment sheet. The treatment sheet of the injured refers to the names of petitioner nos. 1 and 2. So far as the other accused persons are concerned, there are no direct accusations against them. 2 Having considered the same, I am inclined to allow the prayer for anticipatory bail of petitioner nos. 3 to 7. However, so far as the prayer for anticipatory bail of petitioner nos. 1 and 2 [Saddam Hossain @ Saddam Ali & Sultan Hosen @ Sultan Ali] is concerned, the same is rejected. Hence, the prayer for anticipatory bail of the petitioner nos. 3 to 7 is Allowed. Accordingly, I direct that in the event of arrest, the petitioner nos. 3 to 7 [Sahajan Sekh @ Sahajahan Ali, Irsad Ali @ Ersad Ali, Mutaleb Husen @ Motaleb Ali, Muktar Hossain @ Muktar Ali and Sohel Rana] be released on anticipatory bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner no. 3 to 7 shall meet with the investigating officer of the case once in every ten days till the Report in Final Form/ charge-sheet is submitted before the learned jurisdictional court. 3 Accordingly, CRM (A) 1808 of 2026 is Partly Allowed.
