WP No. 18264 of 2026 __________ Page2 of 5 Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus directing the respondents 2 and 3 to furnish all service and monetary benefits of petitioner’s husband deceased S.Murugasen which was granted by an order dated 13.07.2007 passed in W.P.No.20876 of 2005 on the file of this Court and also as per G.O.Ms.No.543 Health and Family welfare (L1) Department dated 28.11.2025 within a stipulated period of time as fixed by this Court. ORDER The writ petition has been filed for the following relief:
“directing the respondents 2 and 3 to furnish all service and monetary benefits of petitioners husband deceased S.Murugasen which was granted by an order dated 13.7.2007 passed in W.P.No.20876 of 2005 on the file of this Court and also as per G.O.Ms.No.543 Health and Family welfare (L1) Department dated 28.11.2025 within a stipulated period of time as fixed by this Hon’ble court.”
2. It is the case of the petitioner that her husband was appointed as Vaccinator on 07.03.1973. As he had completed the Sanitary Inspector Course https://www.mhc.tn.gov.in/judis
WP No. 18264 of 2026 __________ Page3 of 5 on 01.05.1982, he is eligible for promotion as a Health Inspector Grade I from 01.05.1982 itself. While so, her husband filed a writ petition in W.P.No.1119 of 2008 before this Court, seeking all attendant benefits and regularization with retrospective effect which was allowed on 13.07.2007.
3. Thereafter, her husband died on 10.08.2020 leaving the petitioner as legal heir and co pensioner. After filing several contempt petitions, the first respondent passed a government order in G.O.Ms.No.543 dated 28.11.2025, pursuant to which, the petitioner’s husband is entitled to receive all service and monetary benefits. After his death, the petitioner is entitled to receive all his monetary benefits. Hence, she sent a representation dated 11.03.2026 to the respondents 2 and 3. Since there is no response till date, the petitioner is before this Court.
4. Heard the learned counsel on either side and perused the materials available on record.
5. A mere perusal of the records would clearly indicate the fact that the petitioner is entitled to receive her husband’s benefits as per the government
order G.O.Ms.No.543 dated 28.11.2025. Accordingly, this writ petition is allowed and the respondents are directed to disburse the amounts as per the https://www.mhc.tn.gov.in/judis
