Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been implicated in the instant case and is detained for 697 days. In spite of earlier directions the trial till date has not been split up. Learned advocate appearing for the State submits that one of the accused person is absconding and to that effect efforts are being made to trace out the accused. So far as the present petitioner is concerned, the prosecution submitted that 3600 bottles of phensedyl were recovered from a vehicle and the petitioner was present in the said vehicle. Having considered the complicity of the present petitioner and the fact that before splitting up the trial, the learned trial Court is to exhaust the process of law, I am of the view that considering 2 the rigors of Section 37 of the NDPS Act is attracted, this is not a fit case for granting bail to the petitioner. Accordingly, CRM (NDPS) 1307 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
