1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 236/2026 registered at Police Station – Gudhiyari, District- Raipur (C.G.) for the offence punishable under Sections 25 and 27 of Arms Act.

The case of the prosecution is that on 03.06.2026, the police of Police Station Gudhiyari, Raipur, received secret information that the applicant was brandishing a knife near the railway track at Ramnagar Overbridge and threatening passers-by. 2 Thereafter, an FIR was registered, and upon completion of the investigation, the charge-sheet has been filed before the competent Court.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that, instead of initiating preventive proceedings by filing an Istagasa, the police have registered an offence under the Arms Act against the applicant. It is also submitted that no person has lodged any complaint alleging that the applicant had threatened him. The applicant has been in judicial custody since 03.06.2026. The investigation has been completed, and the charge-sheet has been filed. The final adjudication of the case is likely to take considerable time. Therefore, it is prayed that the applicant be released on bail.
4. On the other hand, learned State counsel opposes the prayer for grant of bail to the applicant and submits that the applicant has criminal antecedent of the year 2026 involving offences of a similar nature. Therefore, the applicant is not entitled to be released on bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the submissions made by learned counsel for the parties, the nature of the allegations, the manner in which the applicant allegedly threatened the passers-by in the vicinity, the fact that a knife has been seized from his possession, and further considering that the applicant has criminal antecedents of a similar nature during the year 2026, I am not inclined to release the applicant on bail. Therefore, the bail application stands rejected.
7. Accordingly, the bail application of the applicant - Rajkumar Mankar @ Aadi Mankar involved in Crime No. 236/2026 registered at Police Station – Gudhiyari, District- Raipur (C.G.) for the offence punishable under Sections 25 and 27 of Arms Act, is rejected.

8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance.
