This application has been filed for pre-arrest bail in connection with Kotwali Police Station Case No.88 of 2026 dated February 19, 2026 under Sections 21(b)/29 of the NDPS Act. The petitioner submits that he was arraigned as an accused on the basis of the statement of a co-accused. The statement of the co- accused was not admissible in evidence and as such, the petitioner should be granted anticipatory bail on any stringent condition. 2. From the statement of the accused, Ganesh Paswan, as recorded by the Investigating Officer, it appears that the specific contention of the said Ganesh Paswan was that he used to work for Pagla and Raj of No.2 Ghumti at Jalpaiguri and he supplied 2 brown sugar to different areas of Jalpaiguri. Payment was made by Pagla and Raj. He also stated to the police that if an opportunity was given, he would be able to assist the police in busting the racket. He promised the Investigating Officer that he would lead the officer to Pagla, Raj and Anup. It appears that Raj was arrested and thereafter granted bail after 62 days. 3. Thus, I cannot be persuaded to hold that custodial interrogation will not be necessary in this case. 4. Under such circumstances, the application for anticipatory bail is rejected. 5.
