1. Petitioner prays for bail.
2. 20.815 kgs. of Ganja were recovered from the possession of the petitioner.
3. It is submitted by learned advocate for the petitioner that earlier prayer for bail was rejected. The petitioner again moved for bail in the month of March, 2026, however, such application was not pressed by the petitioner.
4. Learned advocate appearing for the State submits that commercial quantity of narcotic drugs was recovered from the active possession of the petitioner. Moreover, the investigation of the case has ended in charge-sheet against the present petitioner. Forensic report in respect
2 of the recovered articles establishes that seized articles are narcotics. Charges in the case have already been framed and the case is fixed for evidence on behalf of prosecution.
5. It is also submitted by the learned advocate for the petitioner that the petitioner has been in custody for more than 600 days.
6. Having heard the rival contentions and upon perusal of the materials placed, it appears that commercial quantity of narcotic was recovered from the possession of the petitioner.
7. The investigation of the case has already ended in a charge-sheet and the case is fixed for evidence on behalf of the prosecution. Therefore, I am not in a position to hold that the petitioner has been able to overcome the restrictions under Section 37 of the NDPS Act, 1985.
8. In such circumstances, I am not inclined to enlarge the petitioner on bail at this stage.
9. Prayer for bail of the petitioner is rejected.
10. CRM(NDPS) 350 of 2026 is disposed of.
