The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondent authorities to absorb/promote/appoint the petitioner on the post of Shiksha Karmi Grade = III, as absorbed the identically placed Guruji on the said post, in accordance with law. 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.” 2. Learned counsel for the petitioner submits that petitioner was appointed as Guruji vide order dated 20.08.1998 under the Shiksha Guarantee Scheme and pursuant to his appointment, petitioner has been working on the said post. Pursuant to this appointment, petitioner has obtained the requisite qualifications for promotion/absorption on the post of Shiksha Karmi Grade – III. He contended that subsequent to obtaining the requisite qualifications, the petitioner has submitted representations before the respondent authorities for his absorption on the post of Shiksha Karmi Grade – III, however, the same is pending consideration till date. 3. He submits that the petitioner has already submitted representations (Annexure P/7) before the Respondent authorities, however, he submits that petitioner may be permitted to submit a fresh representation before the concerned respondent authorities raising all the grounds as raised in this writ petition for redressal of his grievance and further, the concerned authority be directed to consider and decide the representation of the petitioner at the earliest within specified time frame. 4. On the other hand, learned counsel for the Respondents would submit that as the petitioner is not pressing this writ petition on merits and is only seeking permission to submit afresh representation and direction to the 3 concerned authorities to consider and take decision on the representation submitted by the petitioner, he is having no objection to the limited prayer. 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. Be that as it may, petitioner is permitted to submit a fresh representation before the concerned respondent within a period of 03 weeks from the date of receipt of copy of this order and if such a representation is submitted by the petitioner, the concerned authority shall consider and take decision on the representation to be submitted by the petitioner within a further period of 06 weeks from the date of receipt of the said representation by passing a reasoned and speaking order, absolutely in accordance with law. It is made clear that this Court has not expressed any opinion on the merits of the matter. 7. With the aforesaid observation and direction, this writ petition stands disposed of. No cost(s).
