JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 2 20-08-2026 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. 2. The petitioners seek bail in connection with Fulaut P.S. Case No. 19 of 2025, instituted for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 126(2), 109(1), 117(2), 308(2), 351(2) and (3) of the Bharatiya Nyaya Sanhita, 2023. 3. The prosecution case, in short, is that the petitioners and other accused persons allegedly demanded 1 lakh as ₹ rangdari and upon refusal to lend wheat, formed an unlawful assembly and assaulted the informant and his family members Patna High Court CR. MISC. No.57687 of 2026(2) dt.20-08-2026 2/3 with deadly weapons, causing multiple injuries. It is further alleged that petitioner no. 1 assaulted Md. Sadre Alam by means of gadasa, petitioner no. 2 assaulted Md. Mehtav by means of lathi and petitioner no. 3 assaulted Md. Sabir Alam by means of lathi and iron rod due to which they sustained grievous injuries. 4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. No incriminating material has been recovered from the conscious possession of the petitioners. Learned counsel for the petitioners also submits that the allegation levelled against the petitioners is false and baseless. It is further submitted that two injured persons sustained grievous injuries and the other sustained simple injury. There is case and counter case between the parties in which petitioner nos. 1 and 2 were brutally assaulted by the informant side due to which both of them sustained serious injuries. The petitioners are in custody since 15.05.2026 and have got no criminal antecedent. 5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioners. 6. Considering the aforesaid facts and circumstances of the case, case and counter case between the parties and taking Patna High Court CR. MISC. No.57687 of 2026(2) dt.20-08-2026 3/3 into account the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners. 7. Let the petitioners be released on bail after framing of charge, if not already framed, on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Fulaut P.S. Case No. 19 of 2025, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioners. (II) The petitioners shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioners. Rajorshi/- (Rudra Prakash Mishra, J) U T
