Learned counsel for the petitioner submits that the petitioner retired from the post of Assistant Engineer on 31.08.2009. Despite an order passed by this Court in WPS No. 2453 of 2013 directing the respondents to release his pending retiral dues, several benefits, namely 10% gratuity, deducted pension for the period prior to 2016, second increment, and medical reimbursement, have not been paid. It is further submitted that the petitioner has already deposited the recoverable amount of Rs.1,85,192/- on 27.07.2015. Though the petitioner had earlier filed WPS No. 6050 of 2022, the same was withdrawn due to an inadvertent error in the relief clause. Hence, the present petition has been filed seeking release of the remaining retiral benefits. 2. Learned State counsel submits that the petitioner has already been paid all admissible retiral dues. It is contended that the 10% gratuity was released on 11.04.2016, no amount towards Travelling Allowance or medical claim is outstanding, and the claim for increment is untenable in view of the dispute regarding the petitioner's confidential reports. It is further submitted that the delay in finalization of pension was due to pending disciplinary proceedings and recovery of Government dues, and not on account of any lapse on the part of the respondents. Therefore, the petitioner is not entitled to any further payment or interest, and the writ petition deserves to be dismissed. 3. I have heard learned counsel for the parties and perused the material available on record. 3 / 3 4. Considering the nature of the grievance raised and the rival submissions advanced by learned counsel for the parties, this Court is of the opinion that the dispute involves factual aspects relating to the petitioner's retiral dues, which require examination by the competent authority. Therefore, without expressing any opinion on the merits of the case, the petitioner is directed to furnish a copy of the writ petition along with all relevant documents before the Office of the Advocate General within a period of 15 days from today. Upon receipt thereof, the Office of the Advocate General shall forthwith forward the same to the High Power Pension Redressal Committee. The Committee shall consider and decide the petitioner's grievance regarding the alleged outstanding retiral dues, after affording an opportunity of hearing to the petitioner, the concerned Department and the Office of the Accountant General, by passing a reasoned order in accordance with law, preferably within a further period of 60 days thereafter. 5.
