Rakesh Kainthla, Judge The petitioner has led the present petition for quashing of FIR No. 9 of 2025, dated 10.1.2025, registered at Police Station Rampur Bushehar, District Shimla, H.P., for the commission of o/ences punishable under Sections 281 and 125(a) of Bhartiya Nyaya Sanhita (BNS) and Section 187 of Motor Vehicles Act (MV Act) and consequential proceedings arising out of the said FIR based on a compromise e/ected between the parties. 2026:HHC:3567 2 2. It has been asserted that the complainant, mother of the injured and the accused have entered into a compromise voluntarily without any in7uence from any person, and they have no objection in case the FIR is ordered to be quashed as per the compromise e/ected between the parties. Hence the petition. 3. Statement of the Thakur Moni, mother and Chewag Tashi, father of the minor Riyanshi were recorded on 25.11.2025, in which they stated that they had entered into a compromise with the accused voluntarily without any in7uence from any person, and they did not want to proceed further with the matter because of the compromise e/ected between the parties. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. The o/ence punishable under Section 281 of BNS corresponds to Section 279 of IPC, and the o/ence punishable under Section 125(a) of BNS corresponds to Section 337 of IPC. This Court has already quashed the F.I.R. registered for the commission of o/ences punishable under Sections 279 and 337 of IPC in Sushant vs State of H.P. 2023 HLC 531, Vikas Huda vs. State of H.P. 2023 STPL 3009, Kulwidner Singh vs Ankush Kumar 2023 HLR 2026:HHC:3567 3 384 and Nishant vs. State 2022 Suppl. Law Cases 45 based on compromise. This Court has also quashed the FIR registered for the commission of the o/ence punishable under Section 187 of the MV Act in Suresh Kumar v. State of H.P. 2022 (1) Him L.R. (HC) 81, Vijender Mehta and another Vs. State of H.P. and another (2023) ACC 488 (H.P.) and Sandeep Kumar Vs. State of H.P. and others II (2023) ACC 651 (H.P.), and these judgments are binding upon this Court. 6. Therefore, in view of these precedents, the present petition is allowed and FIR No. 9 of 2025, dated 10.1.2025, registered at Police Station Rampur Bushehar, District Shimla, H.P., for the commission of o/ences punishable under Sections 281 and 125(a) of Bhartiya Nyaya Sanhita (BNS) and Section 187 of Motor Vehicles Act (MV Act) and consequential proceedings arising out of the said F.I.R. are quashed. 7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8.
