For the Petitioner Affidavit of service filed on behalf of the petitioner is taken on record. The respondents are not represented despite service. The petitioner who is the accused in G.R. case no. 2089 of 2025 corresponding to Kolaghat P.S. case no.323 of 2025 dated 26th July, 2025 pending before the learned Chief Judicial Magistrate, Purba Medinipur at Tamluk seeks transfer of the case to any other Court on the ground that the defacto complainant is a practising advocate of Tamluk Court for which none of the advocates therein is willing to represent the petitioner before the Court. The petitioner has also approached the District Legal Services Authority, but the advocates empanelled therein are also reluctant to represent him. The petitioner is not able to defend himself before the learned Chief Judicial Magistrate and has not been able to apply for bail. Upon consideration of the submission made on behalf of the petitioner, specially the fact that the defacto complainant is a practising advocate of Tamluk Court and his influence on the learned advocates therein cannot be 2 ruled out, justice demands that the case be transferred to some other Court to ensure fair trial. In view of the above, G.R. case no. 2089 of 2025 pending before the learned Chief Judicial Magistrate, Purba Medinipur at Tamluk be transferred to the Court of the learned Chief Judicial Magistrate, Paschim Medinipur for trial. The learned Chief Judicial Magistrate, Paschim Medinipur shall either deal with the case himself or assign the same to other learned Magistrate within his jurisdiction. Learned Chief Judicial Magistrate, Purba Medinipur at Tamluk is directed to transmit the record of the case along with relevant documents to the Court of the learned Chief Judicial Magistrate, Paschim Medinipur within 10 days from the date of communication of this order.
