JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners call in question the proceedings in C.C.No.70327/2024 registered for an offence punishable under Sections 498A, 323, 34 of the Indian Penal Code, 1860 ('the - 4 - HC-KAR NC: 2026:KHC:18439 CRL.P No. 1957 of 2026 IPC' for short) and Section 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. Surjith R. Gowda, learned counsel appearing for the petitioners, Sri. B.N. Jagadeesha, learned Additional Special Public Prosecutor appearing for respondent No.1 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and the memorandum of settlement reads as follows: "MEMORANDUM OF SETTLEMENT UNDER SECTION 89 READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. The parties above named submit as follows:- I. The petitioners have filed this joint petition under Section 13-B of the Hindu Marriage Act, 1955 for dissolution of their marriage with mutual consent. The statutory period of six month has been waived off by the Hon'ble court vide its order dated 26.11.2025. II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. In the course of mediation, the 1st petitioner and 2nd petitioner along with their counsel are present, identified each other and they have resolved their dispute and have agreed to the following terms and conditions:- - 5 - HC-KAR NC: 2026:KHC:18439 CRL.P No. 1957 of 2026 1. The petitioners state they are Hindus by religion and their marriage was solemnized on 27.10.2023 at Vasavi Thirumana Mandapam, Punganur Town, Chittor District, Andhra Pradesh, as per Hindu rites and customs. Both the parties are residing at Bengaluru within the jurisdiction of this Hon'ble Court. 2. Both the petitioners state that, due to irreconcilable differences and incompatibility of temperaments, the petitioners have been living separately since 23.01.2024. The efforts made by the elders, friends and well-wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of reunion amongst them since they admit that their marriage is irretrievably broken down. Hence, the petitioners have decided to get the marriage between them be dissolved by a decree of divorce mutually. 3. Both the parties state that they have no children born to them from this wedlock. 4. Both the petitioners are capable of maintaining themselves as such they have no claims of maintenance/permanent alimony against each other. 5. Both petitioners herein state that they have no claims over movable or immovable properties belonging to each other either existing or to be acquired or inherited at a later stage. 6. Both petitioners state that they have already exchanged their valuable articles like gold and silver belonging to each other. 7. Both the petitioners further agree that they have no other claim of whatsoever manner against each other either past, present or acquired in future. - 6 - HC-KAR NC: 2026:KHC:18439 CRL.P No. 1957 of 2026 8. In view of the above settlement arrived between the parties the 1st petitioner undertakes to withdraw M.C No.6212/2024 filed under Section 9 of Hindu Marriage Act, against 2nd petitioner which is pending before III Addl. Prl Judge Family Court, Bengaluru. 9. In view of the above settlement arrived between the parties the 2nd petitioner undertakes to cooperate for closure/quashing of the C.C No.70327/2024 filed under Section 498-A, 323, 504, 506 r/w 34of IPC against the 1st petitioner and his family members, which is pending before 11th ACMM, Mayohall unit, Bengaluru. 10. Both the petitioners further state that there has been no collusion or force, fraud or any undue influence in entering into this agreement in the aforesaid manner. 11. Both the parties admit that they shall not interfere in the personal/profession lives of each other in future. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 27.10.2023 at Vasavi Thirumana Mandapam, Punganur Town, Chittor District, Andhra Pradesh, by granting a decree of divorce by mutual consent in terms of the aforesaid agreement. IV. Parties will appear on 03.12.2025 before the Hon'ble Court for passing orders in terms of the agreement." 4.
