1. This application has been moved by the appellant seeking withdrawal of the Mac Appeal No. 6/2024 titled “Nazia Nazir Mir v. National Insurance Company & Ors.”, against the award dated 30.11.2023 passed by the Motor Accidents Claims Tribunal (MACT), Srinagar, whereby liability for payment of compensation S. No. 50 Suppl- I
has been fastened upon the appellant, as one of the respondent/owner of the offending vehicle.
2. During the pendency of the appeal, the parties have amicably settled the matter out of Court. The appellant, accordingly, seeks permission to withdraw the appeal. The statement of learned counsel for the appellant is taken on record.
3. In view of the ex-curiae settlement arrived at between the parties, the Mac Appeal No. 6/2024 is dismissed as withdrawn along with interim application(s).
4. Interim direction(s), if any, shall stand revoked.
5. The statutory amount of Rs. 25,000/- (Rupees Twenty-Five Thousand only) deposited by the appellant is hereby directed to be released/refunded to the appellant, in accordance with law.
6. CM No. 6104/2024 is, accordingly, disposed of.
