The petitioner is in custody for one year seven months and till date witness action has not commenced. Learned advocate for the State opposes the prayer for bail. I have taken into account the quantum of seizure in the present case and having considered the same, I am of the opinion that some opportunity must be given to the prosecution to adduce its evidence. Having regard to the rigors of Section 37 of the NDPS Act which is squarely applicable in the present case, I am not inclined to enlarge the present petitioner on bail. 2 Hence, the prayer for bail of the petitioner is Rejected.
