He challenges the order dated 18th April, 2026, passed by the learned Chief Judicial Magistrate, Alipore, in S.L. No. 297 of 2025 under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. By the said order, the learned Magistrate rejected the petition filed under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and dropped the proceedings. It appears that the petitioner had filed the aforesaid application alleging, inter alia, that his library membership card issued by the National Library, Kolkata, had been cancelled by the Director General of the National Library. The petitioner further alleged that the cancellation was actuated by "jealousy, vengeance and inferior types of complexities" on the part of the Director General. The allegations contained in the application, even if accepted at their face value, do not disclose the commission of any cognizable offence by the person against whom the allegations have been made. In the aforesaid circumstances, I am of the view that the learned Magistrate rightly rejected the application filed under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and dropped the proceedings. The impugned order, therefore, calls for no interference. Accordingly, CRR 2262 of 2026 is dismissed.
