Rakib (Allowed) CRM (A) 1765 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Narayanpur Police Station case no. 167 of 2026 dated 25.05.2026 under Sections 323/341/325/506/34 of the Indian Penal Code and Section 25(1)(B)(a) of the Arms Act. APP Mr. Sunil Gupta ……for the State. Learned advocate appearing for the petitioners submit that during the pendency of the application petitioner no.11 has been arrested. As such, prayer for anticipatory bail of the petitioner no.11 is dismissed as not pressed. Learned advocate appearing for the petitioners submit that the accusations made in the complaint would reflect that incident complained of commenced from 5th of August, 2020 and the information was submitted with the police authorities on 25th of May, 2026. Learned Additional Public Prosecutor opposes the prayer for bail. 2 Having considered that the petitioners did not evade the process of law till date, I am of the opinion that the incident is of the year 2020, as such I am of the view that at this stage custodial interrogation of the petitioners may not be warranted. Consequently, the prayer for anticipatory bail of the petitioners is allowed (except petitioner no.11). As such, I direct that in the event of arrest, the petitioners be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since the investigation is in progress, I direct the petitioners shall once in every 10 days meet with the investigating officer of the case till the charge-sheet is submitted before the jurisdictional Court. With the aforesaid observations CRM (A) 1765 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
