……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for two years three months. The evidence of victim has already been completed. Learned advocate appearing for the State has opposed the prayer for bail, drawn the attention of the Court to the statement of the victim under Section 164 of the Cr.P.C. I have taken into account the period of detention of the present petitioner and the materials which have been collected by the investigating agency. Having regard to the fact that some more time will be required to take the trial to its logical conclusion, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. 2 As such, the petitioner, namely, Paritosh Bera shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special POCSO Court, Kakdwip, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of South 24 Parganas without prior permission of the learned Special Court. Additionally, petitioner shall not enter into the jurisdiction of Sagar Police Station with prior permission of the learned Special Court. Thus, CRM (M) No. 1240 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
